The EU’s ChatGPT search engine ruling arrived on 31 August 2026, and it is the most useful thing to happen to AI search measurement all year. The European Commission designated ChatGPT a Very Large Online Search Engine (VLOSE) under the Digital Services Act, putting an AI assistant in the same legal bracket as Google Search and Bing for the first time. OpenAI’s own filing triggered it: roughly 159.1 million average monthly users of ChatGPT search inside the EU over the six months to 31 March 2026, more than three times the 45 million threshold that forces designation.
The obligations start biting four months from notification, so around January 2027. OpenAI will have to assess and mitigate systemic risks, submit to an independent annual audit, offer a recommender option that is not built on profiling, open data to vetted researchers, and publish a searchable, API-accessible repository of every advertisement it runs. That last one matters most here. ChatGPT Ads self-serve went live across 31 European markets in the same week, which means the repository will cover real, live, bought placements.
None of this is UAE law. All of it produces UAE-usable data. Brussels is about to publish, for free, the closest thing anyone has to a specification of how the world’s largest AI answer engine selects sources and sells attention. If you sell in a market where 70.1% of working-age adults already use AI tools, that specification is worth reading before your competitors do.

What Brussels actually decided on 31 August

The European Commission designated three services under the Digital Services Act on 31 August 2026: ChatGPT as a Very Large Online Search Engine, and Reddit and Roblox as Very Large Online Platforms. Designation is not a penalty and not a finding of wrongdoing. It is a threshold test. Once a service declares at least 45 million average monthly users in the EU, the DSA’s heaviest tier of obligations switches on.
ChatGPT cleared that bar by a distance. OpenAI reported approximately 159.1 million average monthly active recipients for ChatGPT search in the EU across the six months ending 31 March 2026. The designation can be revoked if usage sits below 45 million for a full year, which is not a scenario anyone is planning for.

Read that right column again. Marketers have spent two years guessing at AI search behaviour from scraped samples and vendor dashboards. A regulator has just ordered the largest player to show its working.
Why a chatbot got classified as a search engine
The interesting part of the decision is the reasoning, not the label. The Commission treated ChatGPT as a hybrid service and concluded it qualifies as an online search engine because, in its words, it responds to users’ prompts and queries, including by searching the web.

That is the same argument agencies have been making to clients since 2024, only now it carries legal weight. The retrieval step is the search engine. The chat interface is packaging. If a system crawls, retrieves, ranks and cites, it competes for the same intent Google does, and it deserves the same line in the budget.
The volume backs it up. SE Ranking’s study of 101,574 websites across 250 countries found ChatGPT’s share of worldwide referral traffic rose from 0.23% in April 2026 to 0.32% in May 2026, a 36.7% jump in a single month. EU referrals grew fastest at 42.7%. Small numbers, steep curve. The same study found 60% of AI-referred visits land on a homepage, against 17% from organic search, which tells you AI answers send people to brands rather than to pages.
The ad repository is the part marketers should care about
Article 39 of the Digital Services Act applies to very large online platforms and very large online search engines that present advertisements. It requires a repository of every ad, published in a dedicated section of the interface, through a searchable tool that supports multi-criteria queries and through an API, held for the entire delivery period and for one full year after the ad last ran.
Until recently that article was theoretical for OpenAI, because ChatGPT carried no ads in Europe. It does now. So within months there should be a public, machine-readable record of the creative running inside AI answers, who paid for it, and the broad parameters it was aimed at. Think of what Meta’s Ad Library did for competitive research in paid social, then apply it to the surface where buying decisions are increasingly being made.
A UAE brand cannot buy ChatGPT ads through self-serve yet. It can absolutely read the repository. Category-level creative intelligence does not respect borders, and the European advertisers in your sector will be testing messaging in AI answers months before that inventory opens locally.
ChatGPT Ads opened across MENA the same week, without the UAE
On 2 September 2026, OpenAI’s Ads Manager availability list went from 9 self-serve countries to 52. All 31 European markets flipped from “coming soon” to available, India came online, and eleven MENA markets were switched on: Algeria, Bahrain, Egypt, Iraq, Jordan, Kuwait, Lebanon, Morocco, Oman, Qatar and Tunisia.
The UAE is not on that list. Neither is Saudi Arabia. The two largest advertising markets in the Gulf are, for now, sitting out a rollout that reached their neighbours.

Being off the list is not the setback it looks like. Paid placement inside an AI answer buys attention. It does not buy the citation, and the citation is what the model repeats when someone asks for a recommendation. UAE brands have a window to win the earned half of the surface while regional competitors are distracted by the bought half. The formats waiting on the other side are already defined: CPM, CPC and conversion bidding, geo-targeting, custom audiences, an OpenAI Pixel and a Conversions API, served only to Free and Go users while Pro and Enterprise stay ad-free.

1. It settles the budget argument
Finance teams push back on generative engine optimisation (GEO, the practice of getting your brand cited inside AI answers) because it looks like a bet on a chatbot. A regulator classifying that chatbot as a search engine, on the basis of 159.1 million EU users, removes the “it is just a fad” objection. AI search is a channel with a legal definition now.

Microsoft’s AI diffusion data puts the UAE first in the world for AI use, with 70.1% of the working-age population using AI tools as of Q1 2026. Singapore is second at 63%. 3. It makes AI referrals worth measuring properly
AI referral traffic is small in volume and heavy in intent. AirOps’ comparison of AI and organic sessions found ChatGPT referrals converting at around 15.9%, with Perplexity near 10.5% and Claude around 5%, well above typical organic search conversion. If your analytics still bundle these into “referral” or “direct”, you are under-reporting your best-performing traffic source and over-crediting the last paid click.

OpenAI’s four-month clock runs to roughly January 2027. That is the window to get your house in order so the new data is useful the day it lands.
Weeks 1 to 3: measure what you already get
Split AI referrers out in GA4 as their own channel group: chatgpt.com, perplexity.ai, gemini.google.com, claude.ai, copilot.microsoft.com. Tag them, then look at assisted conversions, not just last click. Most UAE businesses discover they have been getting AI traffic for a year without naming it.
Weeks 4 to 6: audit your citation surface
Run your 30 highest-value commercial prompts through ChatGPT, Gemini and Perplexity, in English and Arabic, and record who gets cited. Whoever appears is not necessarily ranking first on Google. That gap is your brief.
Weeks 7 to 9: fix what machines read
Structured data, clear entity definitions, dated statistics with named sources, and answers stated in the first paragraph of a page rather than the fifth. AI retrieval rewards the same clarity a rushed human reader does, which is convenient, because that is also what conversion design rewards.
Weeks 10 to 13: build the watchlist
Decide now which EU competitors you will monitor when the ad repository opens, and which of your categories you would test first if UAE self-serve inventory opens in 2027. Write the test plan while it is cheap. Budgets move faster when the plan already exists.
